Terms of Service

Last updated: May 17, 2026. These terms are an MVP operating draft for ViralCast creators and advertisers. Final legal text may change after entity, jurisdiction, tax, and payments review.

1. What ViralCast Does

ViralCast is a marketplace where advertisers create campaign briefs and creators submit short-form video posts or related deliverables for review. ViralCast provides workflow, moderation, records, and payment ledger services. ViralCast is not a social network, employer, talent agency, or guarantor of views, reach, sales, or campaign outcomes.

2. Accounts

You must provide accurate account information. Creators must be at least 18 years old and may be asked to complete identity, tax, or payout checks before withdrawal. Advertisers must provide accurate company and campaign information. You are responsible for activity under your account.

3. Creator Terms

Creators act as independent contractors, not employees of ViralCast or advertisers. Approved submissions create a balance entry according to the campaign and creator tier shown in the product. Rejected submissions are not paid unless ViralCast states otherwise in a written dispute decision.

Creator balances may be withdrawn only after reaching the posted minimum withdrawal threshold, currently $100. Payouts may require KYC, tax forms, provider approval, and anti-fraud clearing. Creators are responsible for their own taxes and for following applicable social platform rules.

4. Advertiser Terms

Advertisers are responsible for campaign claims, product legality, brand assets, landing pages, and any required licenses or approvals. Campaigns may be reviewed, paused, rejected, or restricted by ViralCast. A campaign is not eligible for creator fulfillment until ViralCast marks it active after operational approval.

Unless a separate written agreement says otherwise, advertisers pay for approved deliverables, not guaranteed impressions, clicks, conversions, or creator audience quality.

5. Required Advertising Disclosure

Public sponsored posts must include clear advertising disclosure, such as #ad, paid partnership, or the platform-specific paid promotion tool when required. Creators must not hide the commercial relationship. Advertisers must not ask creators to omit or weaken disclosure. Submissions without required disclosure may be rejected.

ViralCast may approve, reject, reverse, lock, or investigate submissions for quality, disclosure, fraud, policy, legal, or campaign-fit reasons. If a creator deletes a required live post too early, submits a fake URL, or violates these terms, ViralCast may reverse balance entries, deny payout, suspend the account, or remove campaign access.

8. Content Rights

Creators keep ownership of their content. By submitting content through ViralCast, creators grant ViralCast and the relevant advertiser a license to review, store, report, display, and use the approved deliverable for the campaign purpose. Any broader paid media usage, exclusivity, whitelisting, or long-term ad license should be stated in the campaign brief or a separate agreement.

9. Payments and Refunds

Creator balances are ledger entries until paid out by a supported payout provider. Provider fees, failed payouts, sanctions screening, chargebacks, or compliance reviews may delay or block payout. Unused advertiser campaign funds may be handled as campaign credit or partial refund according to the campaign agreement and payment provider rules.

10. Disclaimers and Liability

ViralCast is provided on an MVP/as-is basis during the smoke phase. To the maximum extent allowed by law, ViralCast disclaims warranties and is not liable for lost profits, lost data, platform bans, reduced reach, rejected submissions, or indirect damages. Nothing here limits liability where the law does not allow limitation.

11. Changes

ViralCast may update these terms as the product, legal entity, payment providers, and operating policies evolve. Continued use after an update means acceptance of the updated terms.
